What to check before you buy a plot
- Planning status: for a new home, the land should be classified as urban land (suelo urbano) in the Benahavís town plan. Building on rural land is very limited in Andalucía.
- Buildability: the town plan sets how many square metres you may build, the maximum height and the distance to the boundaries. A large plot with low buildability allows a smaller villa than you may expect.
- Slope and ground: steep plots give the best views but need retaining walls and deeper foundations, which add to the building cost.
- Services: check that water, electricity and drainage reach the plot, and who pays to connect them.
- Project and licence: some plots are sold with an architect’s project or a building licence already applied for. Ask what is included and whether it fits the villa you want.
Taxes when you buy a plot
The tax on a plot depends on who sells it, and the difference is large:
- From a company or developer (building land): 21 percent VAT plus 1.2 percent stamp duty (AJD), about 22.2 percent of the price.
- From a private owner: 7 percent transfer tax (ITP), the same as for a resale home.
- Rustic land that cannot be built on is exempt from VAT, so it pays the 7 percent transfer tax even when a company sells it.
